Grandma goes to jail for slapping cussing granddaughter in Florida.

In what is sure to be painted by the religious far right as another sign of how America is going to hell in a hand basket, 73-year-old Theresa Collier was arrested in Florida for slapping her potty mouthed granddaughter:

Collier says she invited her 18-year-old granddaughter, Felicia Collier, to her house so she could use her computer to do homework.

Felicia is finishing her senior year online after getting kicked out of Catholic school in Massachusetts, Collier explained.

“She said F-off to a nun!  I would just crawl into a hole,” said Collier.

On Tuesday, the newly turned 18-year-old did not want to obey her commands to complete her assignments.

“She kept repeating the F-word to me, about the whole family.  She just went on and on and I just got so upset, I got up and slapped her across the face,” she told 10 Connects, “She grabbed my wrists and I couldn’t get out of it and she let one go and she punched me in the cheek here.”

Sounds like Grandma and her granddaughter didn’t spend much time together as it was. She seems to be somewhat surprised by the girl’s actions so that suggests she doesn’t really know her.

Anyway, the granddaughter called police who showed up and promptly arrested the Grandmother for battery despite the young woman pleading with them not to do so and she spent the next 24 hours in jail.

“I went to medical, they take my blood pressure, it was sky high and he says, my God!  And I said, ‘Can you blame my blood pressure?’ ” said Collier.

“My wife of 52 years went to Catholic Parochial school, went to church, she’s a good strong Catholic and raised four kids and no one ever spoke to her like that,” said her husband, Walter Collier.

Well, someone has spoken to her like that now. I suggest she either gets used to it, learns to restrain her slappy impulse, or doesn’t hang out in Florida too much.

Because as it turns out, dear Grandma is a victim of the rule of unintended consequences. Here, I’ll let the police explain:

While Collier’s arrest seems out of line, under the law, a battery was committed.

“Legally she’s 18-years-old, so while I understand the difference between corporal punishment on a child, disciplining your child for using poor language, this is an 18-year-old child,” said Lt. Mike Loux, with the Largo Police Department.

Lt. Loux says his department has a mandatory arrest policy when it comes to domestic violence calls, so someone had to go to jail.

“If an officer on scene finds probable cause to arrest a person, because they’ve committed domestic battery, then our policy is a mandatory arrest of that person,” said Lt. Loux, “The discretion does not come because the victim does not want to prosecute.  It doesn’t come because the victim has remorse for calling police.”

In short, the kid isn’t a kid as far as the law is concerned and if you go around slapping adults you can and will be charged with battery and if it looks even remotely like domestic abuse in Florida that particular police department will haul your ass in and charge you. It’s that whole zero-tolerance policy showing what a bad idea it is once again. The police don’t have the option of discretion without violating the policy and the unwillingness of the victim to press charges is not enough to keep them from being applied. Which makes sense as it’s often the case in domestic abuse situations that the victims are unwilling to press charges.

The article appears to be painting this as an example of the police overreacting to a spoiled brat getting what she deserves, but if you look at it logically it went down the way it was supposed to when you take the power of discretion away from the police. It’s a reminder that it’s important to consider the rules and laws you set up before you enact them.

Should Grandma have the right to slap a mouthy grandchild? Lots of people seem to think so, but in this day and age of greater awareness of domestic abuse you could find yourself on the wrong side of the law if you do. Best not to associate with them if you don’t like their attitude.

  4. I personally think it is disrespectful of this young woman to use language around her ” Elder ” Grandmother. Grandma may not be right in resorting to physical assault. But if Grandma went around saying Fuck all the time, then it would be different.

    I never once recall my Grandparents using profanity. And, had I used it in front of them, they would have corrected the behavior, probably without a word, but that strange look of disappointment. But I respected my Grandparents. They earned it in the way they treated me,

  5. Completely agree with you, Les, on your last paragraph and especially the last sentence. This story is so sad. I understand the legality aspect, and this highlights that one should not invite the law into personal affairs. I’d be surprised if the girl suddenly reforms, and would hope that the grandparents just write her off and enjoy the time they have left. Not easy though, with love in the way – which is what girls like that one are counting on.

  6. Should the police be required to arrest someone if it appears that domestic abuse has taken place? I’m on the fence about that. I don’t like taking the discretion away, but by that same token, I can just imagine the atmosphere which will follow if they don’t arrest the aggressor. “Yeah, you called the cops, and they did nothing, so I can just do it again, hahaha.” I think the required arrest is the lesser of the two evils here, but that’s my opinion. (I would bet that the two minutes following hearing the cops’ engine start up as they drive away is the most tense time in the world for these people, but if someone gets arrested, it’s a mandatory cool-off period, especially if the police handle everyone with respect. “Yes, I know it appears like everything has been resolved, ma’am, but according to everyone’s story (which all coincides, we really appreciate that, you have no idea), but as the aggressor, we *have* to arrest you for the night. It sounds bad, but it’s really not such a big deal. Are there any preparations you need to make, any articles you need to bring along?” And so on.

    But by the same token, grandma needs to realize she can’t treat her granddaughter as a kid anymore. She’s not going to take it, and the law backs her up on that. If the granddaughter acts like an ass, kick her out of the house, and if she throws a fit, call the cops on her. Being treated like an adult is not a free ticket, you have to earn the respect.

    If the cops are called, everyone should pretty much (by now) know what’s going to happen next.

  7. And the reason we take discretion away from cops, may I remind everyone, is because an awful lot of cops have really poor discretion in the first place. They taser ten year old kids and asthmatic cardio patients, and they pull over people for being too brown in white neighborhoods.

    And yes, this might look like it was an overreaction, but I can just see the clamor if either participant were as nasty a they might be and shot the other one once the police left the scene using discretion (because the 18 year old was hot, or the grandmother matronly and reminding them of their own.) The world is screwed up enough that that sort of thing happens, and also makes it onto SEB.

    Yeah, I’m happy enough with cops working on scripts that amount to do least harm and don’t give people the benefit of the doubt.

Conversely, they wanted the God given freedom of worship declared into law, hence the second clause stating “or prohibiting the free exercise thereof,” including in all branches of Government.
    The Founding Fathers also firmly believed that Christianity and US Government must always be intertwined, as stated by Romans 13.

    Romans 13:1-2, “Everyone must submit himself to the governing authorities, for there is no authority except that which God has established. The authorities that exist have been established by God. Consequently, he who rebels against the authority is rebelling against what God has instituted, and those who do so will bring judgment on themselves”

    Which means that God has established both, the Church, and the Civil Government, therefore the secular ruling authorities such as the U.S. President, the entire U.S Congress, the Justice System, Governors, and Mayors, must all be in submission to Jesus Christ under the authority of the Church or the people, and the Church or the people must be in submission under the headship of Jesus Christ. Thus, according to Romans 13, and the US Constitution, and the will of the Founding Fathers, the church or the people must embody the moral guiding consciousness of the entire Nation.

    The Government on the other hand has the authority to enforce all civil laws, Romans 13: 4, “For he is God’s servant to do you good. But if you do wrong, be afraid, for he does not bear the sword for nothing. He is God’s servant, an agent of wrath to bring punishment on the wrongdoer”

    It is crystal clear that Romans 13 teaches that a wall of Separation between Church and State does not exist, but only inside the minds of deceivers and deceived alike, it is as phony as a three-dollar bill, and one of the biggest hoaxes perpetrated against the church or the people. The First Amendment to the US Constitution was drafted in part, to prohibit the establishment of any particular Christian Denomination from becoming the official national religion of the US, but that does not mean the government should be isolated from the holy, and perfect will of God.

    Patrick Henry, Founding Father, and tireless champion of liberty, in a Speech to the House of Burgesses said, “It cannot be emphasized too clearly and too often that this nation was founded, not by religionists, but by Christians; not on religion, but on the gospel of Jesus Christ. For this very reason, peoples of other faiths have been afforded asylum, prosperity, and freedom of worship here.”

    Patrick Henry was one of the few important Founding Fathers who was an actual, legitimate Christian. He also opposed the ratification of the Constitution. Washington, Jefferson, Hamilton, Franklin, Adams were Deists, as Overlord noted. Jefferson wrote about the separation of church and state, which you note but somehow do not comprehend. President Adams signed the Treaty of Tripoli which declared that the United States is not a Christian nation: “the United States of America is not, in any sense, founded on the Christian religion.” That alone destroys your argument. The Constitution states clearly that there is to be no religious test, and no establishment of religion. It is the duty of the Supreme Court to uphold those laws; Christian theocracy, Christianity of any form, and God himself are mentioned no where in the Constituion. It is the religious right dominionists who are trying to change the nature of the document.

    I would even dispute your interpretation of the book of Romans. Paul is speaking of a Pagan Emperor, not a Christian theocracy. The emperors were not following Christian laws, but the Christians were told by Paul to follow those laws regardless; if the emperor decreed a law that Christians could not follow, Paul teaches the Christian should submit to death. By Paul’s logic Christians have to shutup and follow our laws or… well, you get the picture.

    Luckily, your Bible has no relevance to our system of government, and our country is civilized enough not to persecute the ignorant people who hate our laws; namely Christian theocrats like Pat Robertson and yourself. There are Christian churches everywhere, tax exempt; when some conservative Christians try to claim that their religion is somehow being persecuted they reveal themselves to be idiotic whiners. They talk this way because they do not know what persecution actually looks like, precisely because they are protected by our First Amendment that they hate so dearly. Frankly, we have had too much Christian influence in our government in this past decade, not too little.

    If the Founders wanted to base our laws on the Bible, they would not have needed a Constitution; they could have used the Bible directly. And if we based our laws on the Bible, on the teachings of figures like Moses who murders civilians, women and children, then the U.S. would be a rogue state. On the other hand, if we based our abortion laws on the Bible, then they would remain the same, since the book of Exodus teaches that a fetus does not have the same rights as its parents. So you are out of luck there.

    Religion is not necessitated for moral living. It was primarily Christians who tried to justify the ownership of slaves. Today, you are more likely to support torture if you are a fundamentalist Christian than if you are an atheist. Christians have higher crime and divorce rates than atheists.

    In what way does this violate the US constitution? As far as I can see, all they did was enforce the Establishment Clause. Even the dissenting opinion defined the First Amendment as “a separation of church and state”. You do realize that the goal of the Establishment Clause was to protect religion from the government getting involved, right?

    How many kids have you adopted? Some people are not in a position to take care of children. To terminate a fetus before it has any chance to feel pain is not murder. To say it is murder is to have a disregard for the meaning of the word murder. I have no problem with a woman having control over her own body, and societies where things like abortion are allowed tend to have fewer social problems than those where it is not allowed.

  22. Honestly, I’m on the fence about this. While I think zero tolerance policies are a bad idea in general, I can see the value of one in the case of suspected domestic violence where “police discretion” can be a bit iffy.
