Ed Brayton over at Dispatches from the Culture War points us to this Yahoo! News article which illustrates how the Bush administration seems to think its actions are beyond the review of the courts:
The Bush administration has urged a judge to dismiss a similar case, saying it threatens to divulge state secrets and jeopardize national security. The government argued in briefs that the courts cannot decide the constitutionality of the president’s asserted wartime powers to eavesdrop on Americans without warrants.
Yet another example of how this administration seems to think that being at war gives them carte blanch to do whatever the fuck they want without so much as being questioned. How convenient that the War! On! Terror! is a sort that’s likely to never end. You get the sense that the Republicans are assuming that they’ll be able to maintain their control of the executive branch at the end of Bush’s time as President. How much do you want to bet that if a Democrat manages to take the White House in 2008 there’s suddenly a flurry of Republican Congresscritters claiming the war ended ages ago so that all those special powers Bush claimed are no longer applicable?
As Ed points out on his blog: Without Judicial oversight of the acts of the executive and legislative branches then all our rights are in jeopardy.
